D&D Custom Travel LLC in offering tours, does so only as agents for the various purveyors of transportation and services as outlined in the brochure. Therefore, D&D Custom Travel LLC, shall not become liable or responsible for any loss, injury or damage to person, property or otherwise in connection with any accommodations, transportation or other services or resulting directly or indirectly from acts of God, dangers incident to the water, fire, breakdown in machinery or equipment, acts of government or other civil disturbances, strikes, riots, thefts, pilferage, defaults, delays or cancellations of or changes in itinerary, accommodations or schedules. D&D Custom Travel LLC reserves the right to substitute hotels of equal or better grade if necessary. D&D Custom Travel LLC reserves the right to alter sight-seeing schedules , shows and attractions when necessary. D&D Custom Travel LLC reserves the right to substitute the type of transportation when operationally necessary. D&D reserves the right to accept, decline or retain any person should such a person’s health, mental or physical condition or general deportment impede any person as a participant of a tour at any time, the operation of the tour or the rights, and welfare or enjoyment of other passengers and a refund of unused land tour services is the limit of the agent’s liability should such a person be required to terminate the tour. The right is reserved to withdraw the tour at any time and liability is limited to refund of all monies received. No refund will be granted for unused portions of the tour unless arranged with the operator’s approval, in writing, in advance. Application for membership and/or posting of deposits for the tour shall constitute the participant’s consent to the above terms and conditions.
